SAHAY LAKRA Vs. STATE OF JHARKHAND

JUDGEMENT

(1.) In this writ petition, the petitioner has prayed for a direction on the respondent to promote him to the rank of Deputy Superintendent of Police from the rank of Inspector of Police.

(2.) It has been stated that the petitioner was directly appointed as Sub Inspector of Police in 1976 and after receiving training of Sub Inspector of Police, he was posted at various places. He was allotted Jharkhand cadre in the year 2002. The petitioner was eligible for promotion to the rank of Deputy Superintendent of Police. Other Police Officers, who were similarly situated and even juniors to the petitioner, of 1976 batch, have been given promotion to the rank of D.S.P., but the petitioner has been discriminated against and he has not been given promotion. The petitioner filed representation before the Home Commissioner-respondent No. 2 regarding his said grievance, but the same has also not been considered and no order has been passed till date.

(3.) Learned J.C. To A.G., appearing on behalf of the State, submitted that if the petitioner's representation is still pending or if the petitioner files a fresh representation, the same shall be considered and appropriate order shall be passed.
