JUDGEMENT

(1.) THE petitioner is an accused in the case registered for the offence under sections 406 and 420/34 of the Indian Penal Code .

(2.) LEARNED counsel for the petitioner submitted that the petitioner has been falsely implicated in the case; he is an Assistant Engineer; the work allotted to him was completed by him and the amount- which could not be spent -has been returned; no offence of mis-appropriation of the Government amount is made out against the petitioner; he is permanent Government employee and has permanent hearth and home at Hazaribagh; he is in custody since December,2010; there is no chance of his absconding.
