JUDGEMENT

(1.) Heard the learned counsel for the petitioner and the learned counsel for the State.

(2.) The petitioner is an accused in this case registered under Sections 328/302 of the Indian Penal Code, pending in the court of Chief Judicial Magistrate, Palamau.

(3.) The learned counsel of the petitioner has submitted that though the informant has named the petitioner in the F.I.R but in his restatement, he has not supported the prosecution case. It is further contended that the petitioner is an old man aged more than 67 years and he is also mental patient and he is under the treatment of RINPAS Kanke, Ranchi.
