SONIA DEVI & ORS Vs. STATE OF JHARKHAND

JUDGEMENT

(1.) Anticipatory bail application filed by petitioners, Sonia Devi Nipu Devi, Mathura Thakur, Anil Kumar Thakur @ Anil Thakur, Manoj Kumar Thakur @ Manoj Thakur and Santosh Kumar Thakur @ Santosh Thakur is moved by Sri Arvind Kumar Choudhary learned counsel for the petitioner and opposed by Sri T.N. Verma learned Additional P.P. From perusal of complaint petition and statement of complainant on S.A., I find that only general and omnibus allegation made against petitioners. This is a case under Section 498A of the Indian Penal Code and petitioners are inmates of family of complainant's husband.

(2.) Considering the aforesaid facts and circumstance, I allow this application and direct the petitioners, above named, to surrender in the court below on or before 18th of January 2011. If petitioners surrenders by that time, the learned Court below is directed to enlarge them on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Sri K.K. Srivastava, learned Judicial Magistrate, 1st Class, Madhupur at Deoghar in connection with P.C.R Case No. 475 of 2009 corresponding to T.R. No. 1446 of 2010 subject to the condition laid down under Section 438 (2) of the Cr.P.C.
