(1.) Heard learned counsel for the petitioner, learned A.P.P. for the Prosecution as also learned counsel appearing on behalf of the complainant, who has appeared upon notice.
(2.) The petitioner has been made accused for the offence under Sections 406, 420 and 120(B) of the Indian Penal Code in connection with Complaint Case No. 1877 of 2010.
(3.) From the complaint petition, it appears that the complainant had received a loan of rupees ten lakhs from the Bank and it is also alleged by the complainant that by mortgaging the title deeds of the complainant, the petitioner had obtained another loan of rupees twenty lakhs, which was not being repaid by him. When the complainant received a notice being the Guarantor, the said complaint petition has been filed.
