JUDGEMENT

(1.) THE present writ petition has been preferred by the original Plaintiff of Title Suit No. 65 of 2005 against the order passed by learned Sub Judge I, Dumka dated 10th October, 2007, whereby, amendment application in the plaint, preferred by the original Plaintiff has been dismissed.

(2.) HAVING heard learned Counsel for both the sides and looking to the facts and circumstances of the case, I hereby quash and set aside the order passed by the trial court mainly for the following facts and reasons:
