SHIWAJEE SINGH Vs. STATE OF JHARKHAND

JUDGEMENT

(1.) Heard learned counsel for the parties. Petitioner is accused in connection with Bagodar P.S. Case No.149 of 2010 corresponding to G.R. Case No.1589 of 2010 registered under Sections 302 & 201/34 of the Indian Penal Code which is pending in the Court of learned Chief Judicial Magistrate, Giridih.

(2.) It reveals from the F.I.R. that dead body of a girl, having ligature mark on her neck, was found within the district of Giridih. During investigation the deceased was identified as Priya Singh, daughter of Harendra Singh (niece of the petitioner). The parents and relatives of the deceased have come with a plea that the deceased had committed suicide because she was scolded by them after having love affair with a boy of another cast.

(3.) It is submitted that it has come in the case diary that the deceased had committed suicide, according to the statement of Vijay Bahadur Singh, who is also uncle of the deceased.
