(1.) Anticipatory bail application filed by petitioner, Butru Nag @ Dhaneshar Nag is moved by Md. Zaid Ahmad, learned counsel for the petitioner and opposed by Sri Azimuddin learned Additional P.P. From perusal of first information report and case diary it appears that petitioner has been implicated in this case merely on suspicion.
(2.) CConsidering the aforesaid facts and circumstance, I allow this application and direct the petitioner, above named, to surrender in the court below by 18th of January 2011.
(3.) If petitioner surrenders by that time, the learned Court below is directed to enlarge him on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate Khunti in connection with Rania P.S. Case No. 10 of 2006 corresponding to G.R. No. 163 of 2006 subject to the condition laid down under Section 438 (2) of the Cr.P.C.
