AYUB KHAN Vs. STATE OF JHARKHAND

JUDGEMENT

(1.) Anticipatory bail application filed by petitioner, Ayub Khan is moved by Sri M.B. Lal, counsel for the petitioner and opposed by Sri Prem Prakash, Additional P.P.

(2.) From perusal of First Information Report, I find that the main allegation of using fire arm is against co accused Mubarak Khan. Considering the aforesaid facts and circumstance, I direct the petitioner, above named, to surrender in the court below by 13th January 2011.

(3.) If the petitioner surrenders by that time, learned court below is directed to enlarge him on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Ranchi in connection with Jagannathpur P.S. Case No.236 of 2010 corresponding to G.R. No.3555 of 2010, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
