(1.) Heard counsel for the parties.

The writ petitioner's vehicle, a truck having registration No. JH-02K-2128, was seized on 1st February, 2011 and it was reported that another truck of having same registration No. JH- 02K-2128 was also found along with the truck and therefore, there were two trucks with the same registration number. The matter was investigated and it was mentioned in the F.I.R itself that one truck was registered in the name of the writ petitioner, Sujit Singh, and engine number of his truck being 80B62653485 and chassis number being 42603/BRZ/08587, whereas another truck had, in fact, registration No. WB-15A-2555. The petitioner had moved an application for release of his vehicle, which was rejected by the court of CJM, vide order dated 12th May, 2011. The petitioner then challenged that order by preferring Criminal Revision No. 95/2011, that too was dismissed, vide order dated 6th July, 2011.

Learned counsel for the petitioner submitted that in the FIR itself, it is clearly mentioned that petitioner's vehicle had genuine registration, engine and chassis numbers and another truck was having the fake number of the petitioner's vehicle and that ignoring these two facts, the revisional court in its order mentioned that owners of both the vehicles were using forged registration number and because of this wrong impression, petitioner's application for release of his vehicle was rejected.
