JUDGEMENT

(1.) Heard learned counsel for the petitioner and learned A.P.P. for the State. This is an application for grant of regular bail to the petitioner for the offence under Sections 385/387 of the Indian Penal Code.

It is submitted by learned counsel for the petitioner that as per the First Information Report the allegation is that the somebody gave call to the informant and demanded Rs. 50,000/(Fifty Thousand) from one mobile no. 800258776. From the investigation it transpires that such mobile belongs to one Bhim Sen Soren which has been stolen away from him. The only allegation against the petitioner is that he was arrested and confessed his guilt except that there is no evidence against the petitioner. The petitioner is in custody since 06.09.2010.

(3.) Learned counsel for the State opposed the prayer for bail of the petitioner. In the facts and circumstances of the case and since, petitioner is remained in custody for more than three months, he is directed to be released on bail on furnishing bail bond of Rs. 15,000/(Rupees Fifteen Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sahibganj in connection with Borio (Jirwabari) P. S. Case No. 129 of 2010 corresponding to G. R. No. 266 of 2010 subject to the condition that one of the bailers should be the local residents having property within the jurisdiction of the court and petitioner will appear in court once in every month on the date fixed.
