DINESH PASWAN Vs. THE STATE OF JHARKHAND

JUDGEMENT

(1.) THE Petitioner is an accused in the case registered under Section 412 of the Indian Penal Code.

(2.) LEARNED Counsel appearing on behalf of the Petitioner submitted that the Petitioner has been falsely implicated in this case on the confessional statement of co -accused Pramod Ram @ Pramod Chandravanshi; Petitioner is in custody since November, 2010 but till date he has not been put on T.I. Parade; nothing incriminating has been recovered from his possession; co -accused Pramod Ram @ Pramod Chandravanshi, who named this Petitioner, has been granted bail by this Court in B.A. No. 1082 of 2011; Petitioner is a local permanent resident; there is no chance of his absconding.

(3.) REGARD being had to the facts and circumstances of the case, the Petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/ -(rupees ten thousand) with two sureties of the like amount, each, to the satisfaction of learned Chief Judicial Magistrate, Garhwa in connection with Ranka P.S. Case No. 73 of 2010, corresponding to G.R. No. 1124 of 2010.
