JUDGEMENT

(1.) Heard learned counsel for the petitioner and the learned A.P.P. for the Prosecution.

(2.) The petitioner has been made accused for the offence under Sections 341, 323, 364, 302, 201 and 34 of the Indian Penal Code, in connection with S.T. No. 75 of 2011 arising out of Kuchai P.S. Case No. 17 of 2010 (G.R. No. 690 of 2010).

(3.) The case relates to murder of the son of the informant, who had gone to visit 'Mela', but he did not return. The informant was informed by one Johangendua that two persons, namely, Sukhram Samad @ Ondo and son-in-law of Bula Samad and about 8 to 10 persons, whom they did not recognize, were dragging away the son of the informant. The petitioner has not been named in the F.I.R. and there is no eyewitness to the occurrence.
