JUDGEMENT

(1.) According to prosecution story, the deceased was in jail for the past 9-10 years. In his absence, the solitary accused developed illicit relation with the wife of the deceased for the past 9 years and out of the illicit relation, a son was also born. Panchayat was held in which the accused was fined a cow because of the above.

(2.) The deceased was released on bail in October, 2003. He started living with his wife at his father-in-law house.

(3.) According to prosecution, on the night in between 16-17 April, 2005 between 11 P.M. -12 A.M , the accused committed murder of the deceased and he was seen going away from the place of incident with a blood stained knife by three witnesses which include the wife and son of the deceased.
