JUDGEMENT

(1.) ANTICIPATORY bail application filed by petitioner Subrato Kumar Mandal is moved by Ms. Amrita Banerjee and opposed by Sri P.K. Sahay, learned Additional P.P.

(2.) IT is submitted that co-accused Suresh Kumar Mardi against whom there is similar allegation has been granted anticipatory bail vide order dated 24.2.2011 in ABA No. 3441 of 2010. Petitioner is also ready to deposit his share in the alleged amount of Rs. 4,00,000/- i.e. Rs. 1,33,000/- ( One lakh thirty three thousand only).

(3.) IT is made clear that aforesaid deposit of petitioner will not prejudice him in his defence.
