JUDGEMENT

(1.) THE petitioner is an accused in the case registered under Section 414 of the Indian Penal Code, Section 25(1-b)A/26/35 of the Arms Act and Section 17(i)(ii) of the C.L.A. Act.

(2.) LEARNED counsel appearing on behalf of the petitioner submitted that the petitioner has been falsely implicated in this case; there is no theft report; the allegation of recovery of stolen motorcycle is wholly concocted; as a matter of fact, no incriminating article has been recovered from this petitioner; co-accused Pradeep Kumar Mishra, from whose possession arms were recovered, was granted bail by this Court in B.A. No.1099/2011; petitioner is in custody since September, 2010.
