SARITA PATRALEKH Vs. STATE OF JHARKHAND AND ORS.

JUDGEMENT

(1.) IN this writ petition, the Petitioner has prayed for a direction on the Respondents to pay all deathcumretiral benefits which the Petitioner is entitled to get, as widow of Late Panchanan Patralekh.

(2.) IT has been stated that Panchanan Patralekh was Class IV employee, working in the office of the District Animal Husbandry Officer, Dumka. He died in harness on 29th July, 2000. After the death of her husband, the Petitioner, being widow, is entitled to get deathcumretiral benefits payable to such dependent, but in spite of repeated request and representations, nothing has been paid till date.

CONSIDERING the said submissions, this writ petition is disposed of, giving liberty to the Petitioner to file a fresh representation, along with a copy of this order, before the Regional Director, Animal Husbandry Department, Santhal Pargna Division, Dumka Respondent No. 3. On receipt of the representation, the said Respondent shall consider the Petitioner's claim and pass appropriate order, in accordance with law, within a period of six weeks from the date of receipt of the representation. If the Petitioner is found entitled to get one or the other dues, as claimed by her, admitted amount shall be paid to the her within a period of six weeks thereafter with statutory interest. If the amount(s) found payable to the Petitioner is/are not paid within the said period, she will be entitled to get additional interest @ 10% per annum till final payment.
