JUDGEMENT

(1.) On the last occasion i.e. on 5.8.2009, Jharkhand State Electricity Board was directed to file counter affidavit regarding the claim of interest of the petitioner, but till date, no counter affidavit has been filed by the Jharkhand State Electricity Board, even no counsel is present on behalf of the Jharkhand State Electricity Board.

(2.) However, Mr. Tandon, representing the Bihar State Electricity Board states that counter affidavit has already been filed by the Bihar State Electricity Board.

(3.) The petitioner's claim is with regard to interest on the delayed payment on the retiral dues, as well as the arrears on account of 5 th Pay Revision. The petitioner retired as Electrical Executive Engineer, Electric Supply Area, Dhanbad on 31.1.2002. It is stated in the counter affidavit filed by the Bihar State Electricity Board that all the retiral benefits have already been paid to the petitioner by the Jharkhand State Electricity Board and therefore, the claim of the petitioner for payment of interest, if any, has to be made by the Jharkhand State Electricity Board and not by the Bihar State Electricity Board.
