After some argument, the learned counsel appearing for the petitioner confines his prayer to the effect that the respondent UCO Bank, Dhanbad Branch, Loyabad, Dhanbad shall also be directed to comply the order dated 14/09/2009, passed by the SubJudgeVI, Dhanbad in Title Partition Suit No. 216 of 2009, contained in Annexure4.

From perusal of the aforesaid order dated 14/09/2009, it appears that prior to addition of UCO Bank as a party in the said suit, this order was passed by the learned SubJudge on the petition for injunction filed by the plaintiff that both the parties shall maintain the status quo by way of not aliniating the suit properties to anybody else till the final disposal of the suit. Mr. Tiwary, learned counsel appearing for the petitioner submitted that the UCO Bank has been added as one of the defendant only on 7th May 2010 in the suit pending before the SubJudge and, therefore, he shall also governed by the said order dated 14/09/2009 of the learned SubJudge.
(3.) It goes without saying that any order passed in a suit is binding to all the parties to the suit even added subsequently. Therefore, no specific order is required to be passed on the prayer made by the petitioner. With these observations, this writ petition stands disposed of.
