JUDGEMENT

(1.) Heard the learned counsel for the parties and with their consent this writ application is being disposed of at this stage itself.

(2.) The petitioner's appointment as para teacher in upgraded Primary School, Ramchandrapur in the district of Pakur, was earlier challenged before this Court by one Motiur Rahman in W.P. (S) No. 560 of 2008 on the ground that the petitioner being the son of President of the Gram Shiksha Samittee, was illegally appointed as para teacher by the Gram Shiksha Samittee of which his father was the President. The said writ petition was disposed of by order dated 21.11.2008 contained in Annexure-8 to the writ petition, by which the said writ petitioner Motiur Rahman was directed to approach the Deputy Commissioner cum Chairman, Jharkhand Education Programme, Pakur by filing a representation and the Deputy Commissioner was directed to dispose of his representation by a reasoned order in accordance with law.

It is after this order, the Deputy Commissioner has passed the order as contained in Annexure-9 dated 7.1.2010 after considering the facts and materials before him and thereby cancelled the appointment of the petitioner as para teacher for the reasons stated therein and in his place respondent no. 6, namely, Inaytullah Sheikh, who was just next to the petitioner in the merit list i.e. at serial no.3 has been engaged as para teacher.
