JUDGEMENT

(1.) I have heard both sides.

(2.) This is an application under Section 11(4) of the Arbitration & Conciliation Act 1996 (hereinafter referred as the Act). It seeks appointment of an Arbitrator by the Chief Justice pursuant to Clause 36 of the "Dealer Agreement" dated 4th April 2004 entered into between the parties hereto. A copy of the said Agreement has been filed by the applicant as Annexure- 3.

(3.) There is no dispute that Clause 36 of the said Agreement is an arbitration Clause.
