(1.) The petitioner has prayed for a direction upon the respondents to pay him retiral benefits including pensionary benefits, gratuity, provident fund and leave encashment in respect of the services which, according to him, was payable to him after the date of his retirement from 30.4.1980.

The petitioner was employed in the District Board as Disinfector in the department of Health and prior to his retirement, he was posted at the Primary Health Centre, Tamar under the control of the Civil Surgeon, Ranchi. Claiming the benefit of a Circular issued by the State Government in the concerned Department, the petitioner had prayed for payment of his retiral benefits including pension, gratuity and other benefits.

It appears from the counter-affidavit of the respondents that the petitioner's claim was refused on the ground that since the petitioner was earlier employed in the District Board, he could be entitled to the benefits only as per the service conditions applicable to the District Board and not to the benefits which accrue to the other Government servants.
