(1.) It is submitted that petitioners' case is fully covered by the order dated 30.4.2003 passed in L.P.A. No. 651 of 2002 in the case of Hare Ram Pandey v. the State of Jharkhand and others. It is further submitted that an order similar to the order dated 21.2.2008 passed in W.P.(S) No. 6577 of 2007 may be passed in this case. Petitioners' are claiming statutory interest accrued on arrears of salary for the period 1.1.1971 to 31.3.1973, as instead of paying the same it was credited in their G.P.F. account at the relevant time. It is further submitted such claim is based on the said judgment of Hare Ram Pandey (Supra), but in spite of representations, no order has been passed by the concerned authority.
(2.) State counsel submitted that in absence of instruction, he is not in a position to accept or controvert the statement made in this writ petition.
(3.) If the respondent No. 3 finds that petitioners' case is fully covered by the judgment of Hare Ram pandey (Supra), he will pass necessary order in this regard. If he finds that petitioners case is not covered, he will communicate the reasons thereof to the petitioners. This exercise shall be completed as early as possible and preferably within two months from the date of filing of representation.
