JUDGEMENT

(1.) Heard the learned counsel for the petitioner and learned counsel for the State.

(2.) Petitioner is an accused in a case registered u/s 414 of the I.P.C . It is submitted by learned counsel for petitioner that petitioner has got motorcycle repairing shop and some unknown persons gave him motorcycle for repairing which was kept inside the house from where it was recovered . Petitioner did not know that the said motorcycle was theft motorcycle. Petitioner has remained in custody for about 5 months since, 11.7.2010. There is no criminal antecedent against him.

(3.) Learned counsel for the State has opposed the prayer and submitted that motorcycle was kept inside the house which shows that petitioner knew very well that the motorcycle was theft motorcycle, however, he admits that petitioner has no criminal antecedent.
