JUDGEMENT

(1.) Heard the parties and with their consent this writ application is being disposed of at this stage itself.

(2.) The whole grievance of the petitioner is that though he retired from service of the Notified Area Committee, Sindri on 30th June 2000 as Sweeper but till date his unpaid legal dues of his retiral benefits has not been paid to him in spite of representation made in this regard.

(3.) A counter affidavit has been filed on behalf of Respondent nos. 3 & 4, wherein it is stated that some of the retiral dues of the petitioner has already been paid but it is also admitted at the same time in para 8 that the amount of Gratuity and Leave Encashment to the tune of Rs. 31,294/ and Rs. 19,354/, total Rs. 50,648/ has not been paid to the petitioner. The plea has been taken that the sufficient fund has not been released by the Government for payment of the dues.
