JUDGEMENT

(1.) Heard counsel for the parties.

(2.) The petitioner in this writ application, has challenged the order dated 8.3.2007 issued by the respondent no. 4 whereby, the petitioner's claim for the benefits secured to the Central Government employees who, on their re-employment in the Establishment such as the respondents, are entitled to the benefits in the matter of assessment of scale of pay including pay protection on the basis of the last pay drawn by them in the previous employment.

Claiming his right on the basis of the office memorandum dated 2nd July 1999 issued by the Ministry of Personnel, Public Grievances and Pensions, Department of Pension & Pensioners Welfare, Government of India, the petitioner has demanded that the respondent RINPASS, under whom he is presently employed, should have fixed his salary in the pay scale of Rs. 10,500/- instead of Rs. 5000-8000/-. The petitioner has therefore prayed for a direction upon the respondents not only to fix his salary in the scale on which he claims entitlement, but also to pay arrears of salary which had accrued on the difference of the pay scale.
