(1.) Heard the learned counsel for the petitioner and learned counsel for the State. Petitioner is an accused in a case registered u/s 413,414 of the I.P.C .
(2.) It is submitted by learned counsel for petitioner that petitioner is the owner of the truck no. NL 01 D9243 and as per the F.I.R it was found loaded with steam coal about 22 tonnes and no paper was produced. It is also submitted that petitioner being the owner of the truck has nothing to do with the loaded coal which belong to other co-accused persons. Petitioner is in custody since, 20.10.2010 and hence, he may be enlarge on bail.
(3.) Learned counsel for the State has opposed the prayer. In the facts & circumstances of the case , since petitioner is the owner of the truck and he has remained in custody for some time, he is directed to be released on bail on furnishing bail bond of Rs.10,000(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate Dhanbad in connection with Chirkunda(Galfarbari) P.S. Case No. 192 of 2010 corresponding to G.R. Case No. 3005 of 2010. Further, bailors must be local having property within the jurisdiction of the court.
