JUDGEMENT

(1.) Learned counsel for the petitioner submits at the outset that during the pendency of this writ application and pursuant to the order dated-19.12.2009, the Respondents have paid the arrears of salary on the basis of the revised pay-scale and also on the basis of the revised A.C.P. but the Pension, Gratuity and the balance amount of Group Insurance and arrears of House Rent Allowance have not been paid by the Respondents as yet.

Learned counsel for the Respondents while referring to the statements contained in the supplementary counter affidavit, informs that apart from payments made in respect of arrears of salary on the revised pay-scales, the Respondentsauthorities have forwarded necessary instructions to the office of the Commissioner, South Chhotanagpur Division for confirmation of A.C.P., which has been given to the petitioner and upon receipt of the order of confirmation, the amount of pension payable to the petitioner together with Gratuity, would be assessed and necessary sanction order would be forwarded to the office of the Accountant General to enable issuance of the requisite authority slips and for this, some more time would be necessary.

Considering the above assurances of the Respondents, as conveyed by the learned counsel for the Respondents, this writ application is disposed of with a direction to the Respondents to assess the amount of pension payable to the petitioner on the basis of the revised pay-scales and the benefits of the A.C.P. and also to assess the amount of Gratuity payable to him together with interest, if any, and forward the requisite sanction order to the office of the Accountant General to enable the issuance of the corresponding authority slips to the petitioner for drawing his pension and Gratuity amounts.
