(1.) Mrs. Ritu Kumar, appearing for the petitioner submitted that petitioner has not been given benefits of A.C.P. and has not been paid House Rent Allowances in spite of representation. Counsel for the State submitted that she has received Statement of Facts to the effect that after final bifurcation of the cadre, petitioner joined Jharkhand State on 24.12.2007 and that the office order contained in memo No. 4034 dated 24.12.2008 is pending consideration before the Finance Department, Govt. of Jharkhand for examining and giving concurrence; and after concurrence, the claim of petitioner for A.C.P. will be considered; and that the representation of petitioner for House Rent Allowance will also be considered by the Department. Let a copy of the instructions sent to the State counsel by way of statement of fact, be kept on the record.

In view of such stand taken by the State, petitioner is permitted to file a fresh representation before the Secretary-Cum- Commissioner, Finance Department, Government of Jharkhand, Ranchi and the Director, Provident Fund Directorate, Finance Department, Government of Jharkhand, Ranchi (Respondents No. 2 and 3 respectively) with regard to his claim of promotions under A.C.P. scheme.
(3.) If petitioner is found entitled to his claims, the same should be given to him. If petitioner is found not entitled to any claim/part of it, the reasons thereof should be communicated to him. This exercise should be completed within three months from the date of receipt of such representation. It is made clear that this Court has not gone into the merits of the claims of the petitioner. With these observations and directions, this writ petition stands disposed of.
