SAHJADI BEGUM AND ORS Vs. STATE OF JHARKHAND

JUDGEMENT

(1.) It is submitted by Sri Mahesh Kumar Sinha that petitioner no.2, Chhotu has already been arrested. Therefore, this anticipatory bail application on behalf of petitioner no.2 has become infructuous. Hence, anticipator y bail application of petitioner no.2, Chhotu is hereby dismissed as infructuous.

(2.) Sri Mahesh Kumar Sinha moved the application of petitioner no.1, Sahjadi Begum, which was opposed by Sri S.K. Srivastava, Additional P.P. It appears that petitioner no.1, Sahjadi Begum is the mother-in-law of the informant and no specific overt act alleged against her.

(3.) Considering the aforesaid facts and circumstance, I direct the petitioner no.1, Sahjadi Begum to surrender in the court below by 11th January 2011. If she surrenders by that time, learned court below is directed to enlarge her on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Seraikella in connection with Chandil P.S. Case No. 75 of 2010 corresponding to G.R. No. 513 of 2010, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
