JUDGEMENT

(1.) This appeal by the claimant is for enhancement of compensation.

(2.) We have surprised to see that the Tribunal in case death of an earning member aged about 32 years the court has awarded only Rs. 65,000/-.

(3.) The claimants are the widow-mother and unmarried sister. The deceased was an earning member and according to the claimants, he was earning Rs. 2000/- per month. In spite of the evidence adduced by the claimants, the Tribunal illegally and erroneously take notional income and assessed the compensation on the basis of the age of widow-mother. The approach of the Tribunal is wholly without jurisdiction.
