(1.) Heard learned counsel for the petitioners and learned counsel for the State.
(2.) This is an application for grant of regular bail to the petitioner for the offence under Sections 8(c) and 18 of the NDPS Act.
(3.) It is submitted by learned counsel for the petitioners that petitioners are the owner of Tata 407 bearing Registration No. JH13A0491 and from this Tata 407, 50 bags of Doda were recovered. Petitioners are not named in the F.I.R. and when they went to the police Station for release of their vehicle then the police applied for issuance of warrant against them. Petitioners are in custody since 12.07.2010. It is further submitted that similarly situated coaccused namely Md. Suhail Akhtar, who was the owner of the truck, from which 100 bags of Doda were recovered, was granted bail by a Bench of this Court vide order dated 20.11.2007 in B. A. No. 5944 of 2007 and other coaccused were also granted bail. In that view of the matter, petitioners may be enlarged on bail. In that view of the matter, petitioners, above named, are directed to be released on bail on furnishing bail bond of Rs. 10,000/( Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Sessions JudgecumSpecial Judge, Hazaribag in connection with Chauparan P. S. Case No. 82 of 2007 corresponding to G. R. Case No. 1810 of 2007 subject to cash deposit of Rs. 20,000/( Rs. Twenty Thousand) as security, without prejudice, with the condition that bailor of the petitioners would be their near relatives.
