JUDGEMENT

(1.) Heard.

(2.) It is submitted by Mr. D.K. Pathak, learned counsel appearing for the petitioner that the only grievance of the petitioner is that though he applied for retiral benefits including G.P.F. before his retirement, but the statutory interest on G.P.F. has been paid only for six months without any fault of the petitioner, whereas the petitioner is entitled to the statutory interest till the date of actual payment. Mr. Sidharth Ranjan, learned counsel appearing for the Jharkhand State Electricity Board (for short "the J.S.E.B.") submitted that in the absence of counter affidavit, he is not in a position to accept or controvert the statements made in the writ petition. He further submitted that there is procedure for determining the amount of statutory interest payable on the G.P.F. and it is to be examined whether petitioner is entitled to statutory interest as claimed by him. In the circumstances, the petitioner is permitted to make fresh representation before the Secretary, J.S.E.B. (respondent no. 3) raising the said claim. If the said claim is found legally tenable, it should be paid to the petitioner. If the said claim is not found legally tenable, reasons thereof should be communicated to him. This exercise should be completed within six weeks from the date of receipt of such representation.

(3.) It is made clear that this Court has not gone into the merits of the case of the petitioner. With these observations and directions, this writ petition is disposed of. However no costs.
