JUDGEMENT

(1.) I have heard both sides.

(2.) A counter affidavit has been filed on behalf of respondents no. 2 and 5.

(3.) The impugned order (Annexure-8 to the writ petition) dated 31.1.2001 is an order dismissing the petitioner from service with retrospective effect. It is trite that dismissal order cannot be passed with retrospective effect and on that short ground alone dismissal order is liable to be set aside.
