JUDGEMENT

(1.) Heard counsel for the parties.

(2.) The petitioner in this writ application, has prayed for quashing the order as contained in letter No. 7118 dated 31.12.2003 (Annexure-7), issued by the Deputy Secretary, Personnel and Administrative Reforms, Rajbhasa Department, Government of Jharkhand, Ranchi whereby a direction was issued to pay the petitioners salary equal to his last basic pay minus pension and the amount which was paid to him in excess of the last basic pay, has been directed to be recovered/adjusted against his future pension.

(3.) Facts of the petitioners case in brief is as follows: The petitioner was employed as Secretary to the Secretary in the joint cadre of Personal Assistants under the State of Jharkhand and he retired from service in September 2001.
