V/S
STATE OF JHARKHAND; SECRETARY, WELFARE DEPARTMENT, GOVERNMENT OF JHARKHAND; DEPUTY SECRETARY, WELFARE DEPARTMENT, GOVERNMENT OF JHARKHAND; WELFARE COMMISSIONER, SCHEDULE TRIBE, JHARKHAND; SUB-DIVISIONAL WELFARE OFFICER, KHUNTI Respondents

JUDGEMENT

(1.) Heard counsel for the parties and with their consent, this application is disposed of at the stage of admission.

(2.) Petitioner in this writ application has prayed for issuance of a direction upon the respondents to appoint him, by way of re-appointment/promotion, on Class-III post.

(3.) The petitioner was granted compassionate appointment, pursuant to the recommendations made by the District Compassionate Appointment Committee. It appears that though such recommendation was made and the petitioner was qualified and eligible for his appointment on Class-III post and as per the petitioner's contention, vacancies in the Class-III post were available, yet, he was offered Class-IV post. He accepted the offer, purportedly under protest, and thereafter joined the service on 06.05.1995.
