JUDGEMENT

(1.) Anticipatory bail application filed by petitioner, Santosh Kumar is moved by Sri Nilesh Kumar, counsel for the petitioner and opposed by Sri Shekhar Sinha, Additional P.P.

(2.) It appears that earlier petitioner has filed an application under Section 9 of the Hindu Marriage Act for restitution of conjugal life. However, that application was withdrawn because the complainant was found to be pregnant. Thereafter, petitioner has filed an application for divorce in the year 2007. Thereafter, in the year 2008, the present complaint petition has been filed.

(3.) Considering the aforesaid facts and circumstance, I direct the petitioner, above named, to surrender in the court below by 11th January 2011. If the petitioner surrenders by that time, learned court below is directed to enlarge him on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Ranchi in connection with Complaint Case No. 259 of 2008, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
