JUDGEMENT

(1.) Learned counsel appearing for the petitioners submitted that the salary of difference of pay for the period running from 1st January, 1971 to 31st March, 1973 and interest thereupon have not been paid to the petitioners.

(2.) Learned counsel appearing for the respondents submitted that now a counter affidavit has already been filed and looking to the order passed in Letters Patent Appeal bearing L.P.A. No. 651 of 2002, decided on 30th April, 2003, which is affirmed by the Hon'ble Supreme Court in Special Leave to Appeal (Civil) No. 5803 of 2004, the amount will be paid to the petitioners for the aforesaid period with interest.

(3.) In view of the aforesaid submission and looking to the order passed in Letters Patent Appeal bearing L.P.A. No. 651 of 2002 dated 30th April, 2003, which is also affirmed by the Hon'ble Supreme Court in Special Leave to Appeal (Civil) No. 5803 of 2004, I hereby direct the respondents to make the payment of difference of salary for the period running from 1st January, 1971 31st March, 1973 along with interest, prevailing upon the amount of General Provident Fund, within a period of six weeks from the date of receipt of a copy of the order of this Court.
