JUDGEMENT

(2.) The petitioner is claiming pension under Rule 46 of the Bihar Pension Rules on "special consideration."

(3.) It appears that petitioner was dismissed from service on 15.7.1961 on the ground of misconduct. The said order was challenged by the petitioner and, ultimately, Civil Appeal No. 2138 of 1970 was dismissed by the Supreme Court on 20.7.1970. Thus the order of dismissal became final.
