JUDGEMENT

(1.) Heard learned counsel for the petitioner and learned counsel for the State.

(2.) This is an application for grant of regular bail to the petitioner for the offence under Section 394 of the Indian Penal Code.

(3.) It is submitted by learned counsel for the petitioner that petitioner is not named in the F.I.R. and subsequently he has been named by coaccused Moinuddin Ansari, who confessed his guilt before the police and on the basis of his confession, raid was conducted in the house of this petitioner, from where police seized only sweater having Kathha colour but motorcycle was not recovered from the possession of this petitioner. It is further submitted that petitioner is in custody since 12.12.2009 and as such, he may be enlarged on bail.
