JUDGEMENT

(1.) Mr. Sahay, appearing for the petitioner, submitted that from Annexure-1 it will appear that the lands are Chhapparbandi lands, therefore, encroachment case is not maintainable. He further submitted that a suit was filed by the State, but ultimately it was abandoned and thereafter this encroachment case has been filed. He further submitted that after initiation of present case, the petitioner has also filed suit in which the State has appeared and filed its written statement.

(2.) On the other hand, State counsel pointed out that the petitioner has filed show cause in this encroachment case and the matter is pending before the Circle Officer, Town Anchal, Ranchi.

(3.) In the circumstances, I am not inclined to interfere in the matter at this stage. The petitioner and the State are directed to cooperate in early disposal of the Encroachment Case No. 8 of 2007-08. The Circle Officer, Town Anchal, Ranchi is directed to expedite and conclude the proceeding expeditiously, in accordance with law, as early as possible and preferably within a period of two months from the date of receipt/ production of a copy of this order.
