MAHABIR ORAON Vs. STATE OF JHARKHAND

JUDGEMENT

(1.) This writ petition has been filed against the notice dated 6.11.2009 issued by the Circle Officer, Sadar, Ranchi in S.A.R. Appeal Case No.45 R 15 of 2008-09 asking the petitioner to stop construction over the land in Village Kokar, Khata No. 148 Plot No. 36 Area 1.83 Acres; and to produce documents, if any, with regard to the claim over the said land.

Mr. Sunil Kumar Sinha, learned counsel appearing for the petitioner, referring to the order dated 31.7.2009 (Annexure 3) passed by the Additional Collector, Ranchi in the said appeal, submitted that, according to the petitioner, the said land was not in his possession and, accordingly, the order was passed in the appeal. He further submitted that the petitioner is not making any construction on the said land.

(3.) Mr. L.K. Lal, learned Standing Counsel (Land Ceiling), appearing for the State of Jharkhand, rightly submitted that the petitioner has filed this writ petition only against the notice issued by the Circle Officer, Sadar, Ranchi (respondent no. 4) and, if he has to say anything in this regard,he should have filed his show cause.
