JUDGEMENT

(1.) This writ petition has been filed for quashing the order dated 24.11.2009, passed in Title Suit No. 266 of 2006, by Sub Judge- IX,Ranchi , allowing the petition for intervention filed by respondent no. 6 to 11 herein, under Order 1 Rule 10 read with Section 151 of the C.P.C.

(2.) Mr. P.K. Prasad, learned senior counsel appearing for the petitioners, submitted that the intervention petition filed by the vendors of the interveners on 4.4.2007 was rejected by learned trial court by order dated 15.3.2008 and therefore the present intervention petition could not have been allowed as it is well settled that the principles of res judicata applies at different stages of the suit. He relied on 2008(2) JLJR 243(SC-Ajay Mohan & Ors Vs. H.N. Rai & Ors. and AIR 1980 Patna 143-Puranmal Bajoria Vs.Nagarmal & Ors.

(3.) Mr. Amar Kumar Sinha, learned counsel appearing for respondent nos. 1to 5, supported the impugned order.
