JUDGEMENT

(1.) Heard the parties.

(2.) Learned counsel appearing for the petitioner submits that petitioner nos. 1 and 2 were appointed as Assistant Teachers on 28.2.1985 and 6.9.1989 in R.C. Primary School, Pakartoli, Simdega, whereas petitioner no. 3 was appointed on 1.12.2004 in G.E.L. Middle School, Sawan, Simdega and after appointment they were being paid their salary regularly, but the Authority stopped making payment of salary to these petitioners after March, 2009/ March, 2007. On such stoppage when these petitioners tried to know the reason for non-payment, it was told by the District Superintendent of Education, Simdega that the payment is being not made to them for the reason that the prepositional statement of pay fixation has not been approved by the respondent no. 2 - Director, Primary Education, Human Resources Development Department, Ranchi as a result of which, he is not in a position to pass order for making payment to the petitioners.

(3.) In this respect, learned counsel further submits that several prepositional statements are pending before the respondent no. 2 for its approval and on account of its nonapproval, the salary is being not paid to the petitioners.
