Learned counsel appearing for the petitioner submitted that let this writ petition may be treated as a representation and the petitioner may also be allowed to file a fresh representation with proper averments and annexures and also let a direction may be given to respondent no. 2 to decide the application for compassionate appointment to be given to the petitioner, in accordance with law. The father of the petitioner expired on 15th July, 2005. In fact, the petitioner had applied for compassionate appointment in the year, 2008, but, no decision has been taken, therefore, the present petition has been preferred.
(2.) Learned counsel appearing for the respondents submitted that the application of the petitioner, will be decided in accordance with law, rules, regulations and Government enforceable orders and within stipulated time, as given by this Court.
(3.) In view of the aforesaid submissions, I hereby direct respondent no. 2 to treat this writ petition as a representation. The petitioner is also directed to file a fresh representation with proper averments and annexures as well as with necessary details and respondent no. 2 will take a decision for the compassionate appointment of the petitioner, in accordance with law, rules, regulations, policy and Government enforceable order, within a period of sixteen weeks from the date of receipt of a copy of the order of this Court. If the decision is taken in favour of the petitioner, the benefit will be extended within a period of two weeks thereafter and if the decision is taken against the petitioner, it will be communicated to the petitioner.
