JUDGEMENT

(1.) Heard counsel for the parties.

(2.) The petitioner in this writ application has prayed for a direction upon the respondents to fix the petitioner's pension and to give her all consequential benefits pursuant to the 5th Pay Commissioner Report dated 01.01.1986 and to pay the arrears of salary and pension accordingly.

(3.) The facts of the case is that the petitioner was appointed as an I.A. Trained Teacher in the Non-aided Government Minority School. As per the Government notification No. 3268 dated 05.11.1993, the petitioner was entitled to revision of her salary pursuant to the recommendations of the 5th Pay Commission Report. The petitioner had retired on 31.03.1993 thereafter, though she has been getting her pension which was fixed on the basis of the salary drawn by her prior to the date of retirement, but her grievance is that such salary has not been fixed by revising her pay scale in accordance with the recommendations of the 5 th Pay Commission and the Government Notification of 1993.
