JUDGEMENT

(1.) Heard learned counsel appearing for the petitioner and learned counsel appearing for the B.C.C.L.

(2.) The petitioner, being a brother of the deceased employee, namely, Gobardhan Ram, has come to this Court for directing the authority of the B.C.C.L. to pay the amount of Gratuity, which was to be paid to the deceased employee.

(3.) In course of the submission, learned counsel appearing for the petitioner, by referring to Annexure-2 submits that the petitioner was shown in the service excerpts as a nominee of the deceased and that is the basis for putting fourth his claim over the amount of Gratuity. It was also stated in course of the submission that Nephew of the deceased has also been claiming the amount of Gratuity.
