JUDGEMENT

(1.) Heard.

This writ petition has been filed against the order dated 15.2.2010, passed in Title Appeal no. 4 of 2008 by learned A.D.J., F.T.C. 1, Garhwa, rejecting the petition filed by the petitioner-plaintiff, under Order 41, Rule 27 of the C.P.C. for bringing on record the photo copy of the legal notice sent by the defendants to the plaintiff and the photo copy of the reply to it.

It is submitted that the defendants objected to the said prayer of the petitioner mainly on the ground that the said notice and reply are photo copies but the contents of the same have not been denied by them and therefore such photo copies may be allowed to be marked as exhibit at the appellate stage, in the interest of justice and for proper adjudication of the case.
