(1.) Anticipatory bail application filed by petitioner, Goldi Madhyan is moved by Sri Rajiv Ranjan learned counsel for the petitioner and opposed by Sri T.N. Verma learned Additional P.P.

From perusal of first information report I find that Public Analyst has not found any adulteration in the sample of Kaju Barfi, whereas in the sample of Rasgulla, he found presence of cereal starch. Admittedly, same is not injurious to health. It is also not alleged that petitioner was preparing and selling Rasgulla made of only cheese.
(3.) Considering the aforesaid facts and circumstance, I allow this application and direct the petitioner, above named, to surrender in the court below by 11th of January 2011. If petitioner surrenders by that time, the learned Court below is directed to enlarge him on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Pakur in connection with O.C.R. Case No. 35 of 2010 subject to the condition laid down under Section 438 (2) of the Cr.P.C.
