JUDGEMENT

(1.) Heard the learned counsel for the parties and with their consent this writ application is being disposed of at this stage itself.

The petitioner prayed for direction to the respondents to pay suitable compensation for his physical disablement as well as the expenses incurred by him towards treatment of the injuries sustained by him on 15.4.2009 in course of his duty during the parliamentary Election held in the year 2009.

(3.) It is stated that the petitioner was deployed for election duty as polling Officer and he while going to the polling booth, met with an accident with a police van and received severe injuries. On medical examination by a constituted Medical Board and he was declared to be 45% disabled. According to the petitioner as per the Resolution of the State Government contained in Annexure-6, he is entitled to the suitable compensation as well as expenses incurred by him in course of his treatment. It is further submitted that in similar matter, a Bench of this Court in the case of Rajesh Kumar and others Versus The State of Jharkhand and others i.e. W.P.(C) No. 66 of 2008 by judgment dated 3.12.2008 contained in Annexure-7 to this writ petition has directed the State Government to pay the compensation as well as the expenses incurred by them for their treatment. It is submitted that the case of this petitioner is squarely covered by the aforesaid judgment passed by a Bench of this Court.
